As used in these Terms and Conditions (this “Agreement”), the term “CVJH” refers to Charles V. Jenkins House, LLC, a Utah limited liability Company and the term “Rental Property” refers to the property known as the Charles V. Jenkins House located in Park City, Utah.
As used in this Agreement, the term “Guest” collectively refers to each individual or entity that pays all or any portion of the Rental Fees, as defined below, (the “Primary Guest”) as well as to all other individuals who occupy and use the Rental Property (the “Additional Guests”).
It is the responsibility of each Guest to be familiar with the terms and conditions of this Agreement. Payment of all or any portion of the Rental Fees and/or occupation of the Rental Property demonstrates acceptance of the terms and conditions of this Agreement.

1(URL HIDDEN) Rental Fee Payment.
a(URL HIDDEN) The “Rental Fee” includes any and all costs, expenses, fees or penalties that CVJH may charge the Guest for their occupancy and use of the Rental Property as described under this Agreement including, without limitation, daily or nightly rental fees, check-in/check-out routine cleaning charges, mid-stay cleaning fee (if any), and early check-in or late check-out fees or penalties (if any).
b(URL HIDDEN) The Rental Fee also includes Utah lodging taxes and/or sales taxes.
c(URL HIDDEN) Primary Guest(s) must pay Airbnb a “Reservation Hold Payment” that is the complete amount of the rental. This is 50% refundable until 7 days prior to check-in.
d.The reservation will not be confirmed unless and until the entire Rental Fee has been paid.
2(URL HIDDEN) Reservation Cancellations.
a(URL HIDDEN) Reservations may be cancelled ONLY by emailing CVJH at (EMAIL HIDDEN) The reservation cancellation email must provide adequate information (ie. the name of Primary Guest and the arrival date) so that CVJH can identify the reservation and timely process the cancellation request.
b(URL HIDDEN) As set forth above, in order to receive a refund of all or any portion of the Rental Fee, Primary Guest must cancel the reservation no later than seven (7) days prior to the scheduled arrival date.
c(URL HIDDEN) Failure to comply with the cancellation procedures set forth in this Section will result in loss of all of the Rental Fee.
3(URL HIDDEN) Security Deposit.
(URL HIDDEN)a.Prior to any Guest checking into the Rental Property, a $500 security/damage deposit will be charged via Airbnb that CVJH may use to pay for various damages or penalties resulting from violations of this Agreement, as well as any misuse of the Rental Property which includes, without limitation, any damage beyond normal wear and tear, theft, unauthorized pets, smoking, exceeding occupancy limits, early check-in or late check- out without CVJH’s prior approval, extensive cleaning required following check-out, any other damage to the Rental Property and any fines imposed due to violation of any law, ordinance, rule or regulation by any Guest or any invitee of Guest (for example, excessive noise citation issued by law enforcement, parking citation issued by city, etc.)
b(URL HIDDEN) Provided the Rental Property and all appliances, furnishings and personal property located on the Rental Property are in the same condition as when Guest’s occupancy commenced (normal wear and tear expected), and provided the Common Areas and Common Facilities have not been damaged by any Guest or any Guest’s guest, and provided all terms of this Agreement have been met, the Security Deposit will be refunded within 45 days. Any damage or fines may result in forfeiture of all or part of the security deposit and delay refund of the deposit.
4(URL HIDDEN) Maximum Occupancy. The maximum occupancy of the Rental Property is eight (8) Guests. Any Guests in excess of eight must be approved by CVJH prior to the scheduled arrival date and CVJH reserves the right to permit or deny Guests in excess of eight in its sole discretion. If CVJH, in its sole discretion, permits the number of Guests to exceed eight, an additional Rental Fee of One Hundred and 00/100 Dollars ($100.00) per additional Guest will apply.
HOUSE PARTIES IN OR AROUND THE RENTAL PROPERTY ARE STRICTLY PROHIBITED AND GUEST’S ENGAGEMENT IN SUCH ACTIVITIES PERMITS CVJH TO IMMEDIATELY EVICT ALL GUESTS FROM THE RENTAL PROPERTY WITHOUT REFUND OF THE RENTAL FEE.
5(URL HIDDEN) Primary Guest Minimum Age. The Primary Guest must be at least twenty-five (25) years old. CVJH may require proof of Primary Guest’s age as demonstrated by a valid driver’s license, passport or other government-issued photo identification. If CVJH discovers that the Primary Guest fails to meet this minimum age requirement, CVJH may immediately evict all Guests and the invitees of any Guest, and all payments made by Primary Guest will be immediately forfeited.
6(URL HIDDEN) Check-In. Directs to the Rental Property, along with check-in instructions, will be emailed to the Primary Guest when the Rental Fee has been paid in full. Check-in begins at 4:00 p.m. local time. CVJH will use its reasonable efforts to ensure the Rental Property is clean and ready for occupancy by this time; however, Guest acknowledges that it may be necessary to delay occupancy until the Rental Property is ready. Guest shall not attempt to enter the Rental Property before check-in time.
7(URL HIDDEN) Check-Out. Check-out time is 10:00 a.m. local time. Upon check-out, Guest must follow the departure instructions posted at the Rental Property. Such instructions may include: (a) placing all furnishings and personal property items where they were upon check-in and (b) cleaning of any excessive messes. Failure to follow the departure instructions may result in loss of the Security Deposit.
LATE CHECK OUT: If any Guest fails to vacate the Rental Property or remove their personal belongings by the check-out time, penalties may be deducted from the Security Deposit and/or such penalties may be collected from any Guests who fail to timely vacate the Rental Property. Such penalties may include, without limitation, additional daily or nightly rental fees and/or loss or revenue incurred by CVJH due to the Rental Property not being available for the next group of guests. A minimum $50.00 late check-out fee will be charged if your occupancy beyond check out time interferes with the timely initiation of house-keeping services following your stay.
8(URL HIDDEN) Use of Rental Property. Guest accepts responsibility to properly care for the Rental Property during the occupancy and agrees to: (a) leave the Rental Property in the same condition as when Guest began occupancy, normal wear and tear excepted, (b) replace or repair and pay for any breakage, damage, or loss caused by any Guest or any invitees of Guest, (c) be financially responsible for unwarranted or unneeded service calls,
or any service calls caused by misuse of the Rental Property, (d) immediately report any and all Rental Property problems to CVJH, (e) not enter any Rental Property private storage rooms, closets or spaces and (f) abide by occupancy limits of the Rental Property at all times. Guest agrees not to use the Rental Property for any activity or purpose that violates any laws, rules or regulations.
Any breach of any part of this Section 8 by any Guest will be considered a material breach, and may result in the immediate termination of this Agreement and the immediate eviction of all Guests and their invitees and payment of losses and damages as permitted by law.
9(URL HIDDEN) Excess Charges. Any repair or maintenance problems must be brought to CVJH’s attention within twenty- four (24) hours of occurrence or Guest’s occupancy of the Rental Property. Failure to report such matters to CVJH may result in Guest being held responsible for damages or repairs. Any excessive or unauthorized repair or maintenance expenses incurred by any Guest such as unwarranted or unneeded service calls may be deducted from the Security Deposit.
10(URL HIDDEN) Appliances, Equipment and Utilities.
a(URL HIDDEN) CVJH cannot guarantee against the failure or unavailability of heating, refrigerators, ovens, hot tubs, TVs, satellite receivers, DVD players or other similar appliances or equipment. Likewise, CVJH cannot guarantee against outages of utility services such as electricity, gas, water, plumbing, cable television, satellite TV service, Internet or telephone service. CVJH assumes no responsibility or liability whatsoever for any alleged or actual Guest loss or damage directly or indirectly related to the malfunctioning of any appliances or equipment, or the outage of any utilities.
b(URL HIDDEN) Guest must immediately report to CVJH any inoperative appliances or equipment. CVJH
will make every reasonable effort to have repairs performed as quickly as possible, but cannot guarantee repair will be completed during Guest’s stay.
(URL HIDDEN) c(URL HIDDEN) In the event of any persistent failure of certain critical major appliances, equipment or utilities that cause the Rental Property to become unsafe or unusable (i.e. heating, major appliances, electricity, gas or water) CVJH will provide a reasonable reduction of the Rental Fee as determined by CVJH.
11(URL HIDDEN) Rental Fee Reduction / Refund Policy. CVJH is under no obligation to provide Guest with any form of compensation, refund or reduction of Rental Fee for the malfunctioning of minor appliances or equipment or for temporary utility outages. Likewise, no compensation, refunds or reduction of Rental Fee will be given for: (a) delayed arrivals, (b) early departures, (c) reduction in the number of nights reserved less than 30 days prior to the scheduled date of arrival, (d) loss, damage or injury to persons or their personal property; (e) weather/road conditions, (f) natural disasters, (g) too much snow or not enough snow or (g) any reason or circumstance that is beyond CVJH’s reasonable control.
12(URL HIDDEN)Towels and Linens. A basic supply of towels and bed linens will be provided at the beginning of
Guest’s stay. Towels and linens are not normally washed, changed or replenished during Guest’s stay unless a mid-stay clean is requested for an additional fee.
13(URL HIDDEN) Furnishings. Rental Property furnishings are subject to change without notice. Furniture, bedding, mattress pads or similar furnishings supplied with the Rental Property must not be removed from the Rental Property. Any damage to or loss of these furnishings will result in deductions from the Security Deposit. Furnishings must not be moved in any manner that may damage floors or walls, or that would pose any fire or safety hazards. Any furnishings that have been moved by Guests during their stay must be moved back to their original position upon Guest’s departure.
14(URL HIDDEN) Parking. The Rental Property has 2 car parking available in its driveway. The Rental Property may be subject to parking rules, regulations or policies as adopted and/or enforced by local government agencies. Guest is expected to be aware of, and fully comply with, such parking rules, regulations or policies. Guest is advised not to park any trailers at or near the Rental Property without CVJH’s prior written permission.
NEITHER THE CVJH NOR THE OWNER OF THE RENTAL PROPERTY SHALL ASSUME ANY LIABILITY OR RESPONSIBILITY WHATSOEVER FOR ANY DAMAGE OR COSTS INCURRED BY ANY GUEST AS THE RESULT OF ANY VEHICLE OR TRAILER BEING PARKED AT OR NEAR THE RENTAL PROPERTY, OR BEING TOWED.
15(URL HIDDEN) Pets. PETS ARE ABSOLUTELY PROHIBITED IN THE RENTAL PROPERTY UNLESS OTHERWISE APPROVED BY CVJH IN ADVANCE AND IN WRITING. Any evidence of pets in the Rental Property may result in immediate eviction, forfeiture of all amounts paid, and additional cleaning fees being deducted from the Security Deposit. THE MINIMUM PENALTY FOR EACH UNAUTHORIZED PET IS $500.
16. Smoking. SMOKING IS STRICTLY FORBIDDEN IN, OR WITHIN 25 FEET OF, THE RENTAL PROPERTY. Evidence of smoking in or near the Rental Property will result in immediate eviction, forfeiture of all amounts paid and will result in additional cleaning fees deducted from the Security Deposit. The minimum deduction from the Security Deposit for any evidence of smoking is $200, but the entire Security Deposit may be forfeited at the owner/property manager's discretion alone for evidence of smoking.
17(URL HIDDEN) Fire Extinguishers. The Rental Property is equipped with at least one fire extinguisher, which is usually stored in the kitchen or laundry areas. Guests agree to make themselves familiar with the location and function of the fire extinguisher(s). In case of any emergency please immediately call 911.
18(URL HIDDEN) Spa Access. Guests are permitted to use the 8x8ft Grand Bahama Artesian Spa with 62-jet package and lounger. The spa has a hydraulic lift cover. Please ensure that the spa is covered at the end of each use. The jets will turn off automatically if not reset. No more than 6 guests may use the spa at any given time.
GLASS CONTAINERS AND FOOD ARE PROHIBITED IN AND AROUND THE SPA AREA.
19(URL HIDDEN) Gas Stove Heater. No burning of anything other than natural gas in the gas stove heater is permitted. The gas stove heater cannot handle wood or any other materials and will become an instant fire hazard if used improperly. When the gas stove heater is being used, Guests must watch the gas stove heater closely and frequently. The gas stove heater has an automatic timer that will shut off after one hour.
20(URL HIDDEN) Use of Special Amenities – Waiver of Liability.
a(URL HIDDEN) The Rental Property includes certain “Special Amenities” such as the spa and gas stove heater, each described above. These Special Amenities are considered luxury amenities and are not guaranteed to be available or functioning during Guest’s stay.
b(URL HIDDEN) Guests, and the invitee of any Guest, must comply with any rules and regulations governing the use of Special Amenities (i.e. hours of use, noise restrictions, maximum number of users, consumption of food, use of glass containers, etc.). Violation of such rules and regulations may result in Guests being banned from further use of the Special Amenities.
c(URL HIDDEN) Guests understand that special risks may be involved in using Special Amenities, such as slippery surfaces when the areas surrounding the Special Amenities becomes wet. Guests specifically acknowledge and understand that Special Amenities may pose dangers to: (i) children who are not carefully supervised (ii) any person with known or unknown health risks, (iii) any person who is pregnant; or (iv) any person using Special Amenities while intoxicated or using any kind of drugs or medication. Guests agree to explain the risks of using
the Special Amenities to their invitees, and also agree to be fully and solely responsible for any accidents his/her invitees may incur.
d(URL HIDDEN) Guests understand and accept the risks discussed above and agree that they will assume responsibility for themselves and their invitees for the consequences of those risks. Guests agree to waive any claim whatsoever against CVJH for any accidents or claims arising from the use of any Special Amenity by any Guest or any invitee of any Guest. Guests also understand and agree that they are responsible and liable (and will pay CVJH upon request) for any damages that may occur to any Special Amenity due to misuse and/or negligence including, for example, walking on the spa cover or damaging the liner, allowing the spa water level to become too low, or causing water overflow which damages the Rental Property or any surrounding property.
WITH FULL KNOWLEDGE OF THE ABOVE FACTS AND WARNINGS, GUESTS FULLY ACCEPT AND ASSUME ALL RISKS INVOLVED IN OR RELATED TO THE USE OF SPECIAL AMENITIES.
21(URL HIDDEN) Winter / Snow Conditions. Guests are advised that the Rental Property is located in a mountainous and extreme winter climate area. Vehicles equipped with four-wheel drive and/or snow tires are strongly recommended. In the event of snowfall, snow will be removed from driveway(s) and parking areas serving the Rental Property as soon as reasonably possible. Please be advised that heavy snowfalls may result in delayed removal of snow from driveway(s) and parking areas. Please also note that such snow removal service does not include removal of any snow that may be on, or immediately near, your vehicle.
22(URL HIDDEN) Christmas Trees. Christmas trees pose a fire hazard and cause excessive clean-up efforts. As a result, Christmas trees are strictly prohibited in the Rental Property. If any Christmas trees or similar items are used in the Rental Property, Guests will be charged for excess cleaning expenses.
23(URL HIDDEN) Excessive Noise. The Rental Property is located in a quiet residential neighborhood. Quiet hours are from 10:00 p.m. local time until 7:00 a.m. local time. Guests agree not to undertake any activities that interfere with their neighbors' right to quiet enjoyment of their property. Further, Guests agree to fully comply with local noise regulations and to use common sense in keeping noise volume low after dark. Any enforcement actions by local law enforcement are at the Guests’ sole risk and expense and may result in additional deductions from the Security Deposit, immediate eviction and/or forfeiture of all amounts paid.
24(URL HIDDEN) Casualty or Destruction Should the Rental Property be destroyed or rendered uninhabitable by an event beyond the reasonable control of CVJH (including, but not limited to storms, floods or fires or any environmental disaster), this Agreement shall become null and void, and Primary Guest(s) will be entitled to
a refund of all or a pro-rated portion of any portion of the Rental Fee that has been paid. In the event of such casualty or destruction, Guests’ sole remedy will be a complete or partial refund of the Rental Fee, as determined by CVJH. Guests shall not be entitled to any other compensation or damages that may be directly or indirectly related to such casualty or destruction.
25(URL HIDDEN) Falsified Reservations. Any reservation obtained under false pretense (i.e. using false name(s), stolen credit card(s), etc.) will be subject to forfeiture of any amounts paid, Guests will not be permitted to check into the Rental Property and/or will be subject to immediate eviction, and the parties involved in such false pretenses will be reported to law enforcement officials.
26(URL HIDDEN) Disclaimer of Warranties. Guests and invitees of Guests expressly acknowledge and agree that their use of the Rental Property is at their own risk and that Guests and invitees of Guests assume all risk with respect to their use of the Rental Property. CVJH expressly disclaims any and all warranties of whatever kind or nature, whether express or implied, relating to the Rental Property. CVJH makes no warranty that the Rental Property will meet Guests’ expectations or that the information about the Rental Property is error free or accurate.
27(URL HIDDEN) Indemnification and Insurance. Guests shall, during the term of this Agreement and at all times thereafter, indemnify, release, discharge and hold harmless CVJH from and against any and all damages, penalties, claims, causes of action, liabilities, fines, losses and other costs and expenses, including without limitation
court costs, settlements, judgments and reasonable attorneys’ fees and other legal costs, caused by: (i) Guest’s occupation and use of the Rental Property, (ii) Guest’s negligent or otherwise tortious acts; (iii) any breach by Guest of any covenants, restrictions or obligations under this Agreement and (iv) any third party claims, demands or lawsuits of any character, name or description that, with respect to Guest’s occupation and use of the Rental Property, allege personal injury or death, property damage or infringement of copyright, patent right or other proprietary right. Guests are encouraged to secure travelers or vacation insurance.
28(URL HIDDEN) Enforcement Fees and Costs. If CVJH is forced to employ legal counsel and/or professional collection services in order to enforce any provision of this Agreement, including without limitation, eviction of any or all Guests or collection of any amounts due, Guests shall reimburse CVJH for any and all costs associated with such enforcement, eviction or collection matters including, without limitation, reasonable attorneys’ fees.
29(URL HIDDEN) Governing Law. The laws of the State of Utah govern the validity, performance and enforcement of this Agreement and the Parties intend that this Agreement be construed in accordance with Utah law without regard to conflicts of laws principles.
30(URL HIDDEN) Interpretation. The section headings appearing in this Agreement are inserted only as a matter of convenience and in no way define, limit, construe or describe the scope or intent of such sections or paragraphs of this Agreement or in any way affect this Agreement.
31(URL HIDDEN) Survival. The provisions of this Agreement that by their sense and context are intended to survive completion of performance or termination of this Agreement, including, but not limited to, all indemnification covenants, survive the termination of this Agreement.
32(URL HIDDEN) Waiver. The failure of CVJH to insist on performance of any of the terms and conditions contained in this Agreement or to exercise any right or privilege contained in this Agreement will not be considered a waiver of any such term, condition, right or privilege. No waiver is effective unless reduced to a writing that is executed by both Parties.
33(URL HIDDEN)Remedies. The rights and remedies reserved to the Parties in this Agreement are not exclusive; rather, the rights and remedies set forth in this Agreement are in addition to any and all remedies available at law or in equity.
34(URL HIDDEN) Severability. If any term or provision of this Agreement is determined to be unenforceable or invalid for any reason, such unenforceability or invalidity will not affect the enforceability or validity of the remainder of this Agreement as long as the economic or legal substance of the transactions contemplated in this Agreement will not change so as to become materially adverse to either Party. Upon a determination that any term or provision of this Agreement is unenforceable or invalid, the Parties shall negotiate in good faith to modify this Agreement so that the transactions contemplated in this Agreement are fulfilled in a manner most closely reflecting the Parties’ original intent.
35(URL HIDDEN) Entire Agreement. This document contains the entire Agreement between CVJH and Guest with respect to the rental of the Charles V. Jenkins House and supersedes all prior agreements and understandings, oral or written, between the Parties with respect to the same. No handwritten changes will become a part of the Agreement unless and until they are expressly agreed to in writing by CVJH. This Agreement may only be modified in a writing signed by both Parties.
Guest accepts all of the terms of this Rental Agreement.
